Scope of cover:

Sum Insured

- Fire Loss of Profit Policy

Scope of cover:
This policy operates in the event of damage to the premises of an insured due to any peril insured under the Standard Fire & Special Perils Policy, causing an interruption to his business. It enables the insured to recover:- 1) His Loss of Gross Profit due to a reduction in turnover
- 2) Increased Cost of Working incurred in minimizing that loss of Gross Profit.
Definitions
Gross Profit is the sum of Net Profit and Insured Standing Charges.
Net Profit
Net Profit is the 'Net Trading Profit' excluding capital receipts, accretions and outlay chargeable to capital after making provisions for all standing charges but prior to deduction of tax.
Standing Charges
Standing Charges are expenses which do not diminish proportionately with a reduction in turnover. Indemnity Period commences with the date of the damage, and lasts till such time as the business is restored to its pre-damage level, or the period stipulated in the policy, whichever is earlier. This policy insures earnings of the business lost during the Indemnity Period.
Basis of Sum Insured
This is based on the annual net profit of the business as per the previous year's accounts plus the 'standing charges'. An Insured is entitled to return of premium (not exceeding 50% of the premium paid) in case the Gross Profit earned during the financial year concurrent with the period of insurance is less than the Sum Insured.

Scope of Cover:
Professional Indemnity Policy covers all sums which the Insured becomes legally liable to pay as damages caused by or alleged to have been caused by error, omission or negligence on the part of the Insured whilst rendering professional service during the Policy period, including legal costs and expenses incurred with the prior consent of the insurer. The Policy is always issued with a limit of liability and it shall not be permissible to issue any Professional Indemnity Insurance Policy with unlimited liability.

- Services rendered under the influence of intoxicants or narcotics.
- Any Third Party Public Liability.

Under Commercial General Liability Insurance all persons/ firms/ associations/ companies which own, operate or engage in commercial activities and seek to protect the third party bodily injury and property damage can opt for this Policy. The limit of insurance is opted by the client and with a maximum ratio of 1:4 between Any one Accident and Any one Year. This policy only applies to claims for damages for injury or Damage caused by an Accident that takes place at the Insured Premises or any personal or advertising injury caused to third party or any liability arising out products completed operations or any errors & omissions arising out of any commercial activity carried by the insured, In accordance with the Operative Clause, but only such claims in connection with Insured's Business specified in the Schedule. The Policy covers the following:
- a) Death of or injury to any person

- c) Defence Costs within the Limit of Liability
COVERAGES
COVERAGE A. BODILY INJURY AND PROPERTY DAMAGE LIABILITY- a) We will pay those sums that the Insured becomes legally obligated to pay as compensatory damages because of ?bodily injury? or ?property damage? to which this insurance applies. No other obligation or liability to pay sums or perform acts or services is covered unless explicitly provided for under SUPPLEMENTARY PAYMENTS ? COVERAGES A, B, and C. This insurance applies only to ?bodily injury? and ?property damage? which occurs during the policy period by an ?occurrence? in connection with business of the insured and within the ?coverage territory?. We will have the right and duty to defend any ?action? seeking those damages, but:
1) The amount we will pay for compensatory damages is limited as described in SECTION III - LIMITS OF INSURANCE;
2) We may investigate and settle any claim or ?action? at our discretion; and
3) Our right and duty to defend ends when we have used up the applicable limits of insurance in the payment of judgments or settlements under Coverages A, B or C. - b)Compensatory Damages because of ?bodily injury? include compensatory damages claimed by any person or organisation for care, loss of services or death resulting at any time from the ?bodily injury?.
- c)?Property damage? that is loss of use of tangible property that is not physically injured shall be deemed to occur at the time of the ?occurrence? that caused it.
COVERAGE B. PERSONAL AND ADVERTISING INJURY LIABILITY
- We will pay those sums that the Insured becomes legally obligated to pay as compensatory damages because of ?personal injury? or ?advertising injury? to which this insurance applies. No other obligation or liability to pay sums or perform acts or services is covered unless explicitly provided for under SUPPLEMENTARY PAYMENTS COVERAGES A, B AND C. This insurance applies only to ?Personal? and/or ?Advertising? (of your goods & services) injury only caused by an offence which occurs during the policy period, in the coverage territory and in connection with the business of the insured. We will have the right and duty to defend any ?action? seeking those compensatory damages but:
1) the amount we will pay for compensatory damages is limited as described in SECTION III - LIMITS OF INSURANCE;
2) we may investigate and settle any claim or ?action? at our discretion; and
3) our right and duty to defend end when we have used up the applicable limit of insurance in the payment of judgments or settlements under Coverages A, B or C.
COVERAGE C. TENANT?S LEGAL LIABILITY
We will pay those sums that the Insured becomes legally obligated to pay as compensatory damages because of ?property damage? to which this insurance applies. No other obligation or liability to pay sums or perform acts or services is covered unless explicitly provided for under SUPPLEMENTARY PAYMENTS - COVERAGES A, B AND C. This insurance applies only to ?property damage? to premises rented to you or occupied by you. This insurance applies only to ?property damage? which occurs during the policy period. The ?property damage? must be caused by an ?occurrence?. The ?occurrence? must take place in the ?coverage territory?. We will have the right and duty to defend any ?action? seeking compensatory damages but:- a) the amount we will pay for compensatory damages is limited as described in SECTION III - LIMITS OF INSURANCE;
- b) we may investigate and settle any claim or ?action? at our discretion; and
- c) our right and duty to defend end when we have used up the applicable limit of insurance in the payment of judgements or settlements under Coverage A, B or C.
COVERAGE D. ERRORS AND OMISSIONS LIABILITY
- a) We will pay those sums that the Insured becomes legally obligated to pay as compensatory damages because of ?wrongful act?, to which this insurance applies. No other obligation or liability to pay sums or perform acts or services is covered unless explicitly provided for under SUPPLEMENTARY PAYMENTS - COVERAGES A, B, C & D. We will have the right and duty to defend any ?action? seeking those compensatory damages. But:
1. the amount we will pay for compensatory damages is limited as described in SECTION III - LIMITS OF INSURANCE;
2. we may investigate and settle any claim or ?action? at our discretion; and
3. our right and duty to defend end when we have used up the applicable limit of insurance in the payment of judgments under Coverages A, B, D or E or medical expenses under Coverage C. - b) This insurance applies to ?wrongful act? only: Committed in the ?coverage territory? during the policy period; and arising out of the conduct of the business of the insured.

As a manufacturer supplying products, you are always susceptible to the possibility that your product could cause damage to a third party ? either property or a person. A small defect could open up to massive claims. In such a case, Shriram General?s Product Liability Insurance is vitally important for product manufacturers. The policy not only protects your organisation from claims but also covers legal costs associated with defending these claims against your organisation.
COVERAGES
The policy covers all sums (including defence costs) which the insured becomes legally liable to pay as damages as a consequence of:- Accidental death/bodily injury or disease to any third party;
- Accidental damage to property belonging to a third party;
Arising out of any defect in the product manufactured by the insured and specifically mentioned in the policy after such product has left the insured?s premises. Coverage is written on a claims made basis, i.e. a liability policy that provides coverage for an injury or loss if the claim is first reported or filed during the policy period. However, the policy offers the benefit of retroactive date, i.e. a date stipulated in a claims-made liability policy declarations section as the first date of incidents covered by the policy. The retroactive date is designed to provide coverage for claims resulting from incidents that take place prior to the current policy term. Renewal claims-made policies usually have the retroactive date of the first policy issued to the insured. When this is not done, there is a gap in coverage.
ADD-ON COVERS- a) Technical Collaborators Inclusion Clause: This policy may be extended to include the legal liability of Collaborator with respect to the technical Collaboration Agreement between the Insured and the Collaborator. No claim shall be payable under this policy unless the cause of action arises in India and the liability to pay claim is established against the Insured in an Indian Court, except for the claims in respect of exports of products covered under the Policy.
- b) Vendor?s Liability Extension: This Policy may be extended to include any person or organisation designated below (herein referred to as 'vendor') as an insured but only with respect to the distribution or sale in the regular course of the vendor's business of the Insured's products. However if Insured is not the manufacturer of the Product & it is manufactured by Sub-Contractors and/or Loan & Licence Manufacturers on their own brand name, the same can be covered under the Products Liability Policy by charging an additional premium.
- c) North American Jurisdiction Extension Clause: The Policy may be extended to cover for the indemnity to be granted in respect of any judgement, award or settlement made within countries which operate under the laws of the United States of America or Canada (or to any order made anywhere in the world to enforce such judgement, award or settlement either in whole or in part) such extension where a specific amount has been entered against 'Applicable Excess', and where a specific date has been entered against "Retroactive Date" in the Schedule under the heading "North American Jurisdiction".
EXCESS:
Exports to U.S.A/Canada: All Policies covering exports to U.S.A/ Canada shall bear a Compulsory Excess of 1% of the limit of indemnity per any one accident subject to a minimum of Rs. 4,000/-. Domestic Turnover & / or Exports to OECD & Non-OECD Countries: All Policies covering Domestic Turnover & / or Exports to OECD & Non-OECD Countries but excluding exports to U.S.A/Canada shall bear a Compulsory Excess of 0.5% of the limit of indemnity per any one accident subject to a minimum of Rs. 2,000/- This Compulsory Excess shall be applicable to both (a) death/bodily injury (b) property damage, inclusive of defence costs arising out of any one accident. The Company's liability shall attach for the claim in excess of such Compulsory Excess (and Voluntary Excess, if any, opted by the Insured).
EXCLUSIONS
This Policy does not cover liability- a) for costs incurred in the repair, reconditioning, modification or replacement of any part of any product which is or is alleged to be defective;
- b) for costs arising out of the recall of any product or part thereof;
- c) arising out of any product which with the Insured's knowledge is intended for incorporation into the structure, machinery or control of any aircraft;
- d) arising out of deliberate, willful or intentional non- compliance of any statutory provision.
- e) arising out of pure financial loss such as loss of goodwill, loss of market etc.
- f) arising out of fines, penalties, punitive and/or exemplary damages;
- g) directly or indirectly occasioned by happening through or in consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power;
- h) directly or indirectly caused by or contributed to by or arising from;
1) ionising radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel
2) the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof;
- i) for damage to property belonging to the Insured or held in trust or in custody or control of the Insured or a person in the service of the Insured.
- j) arising out of Injury and/or Damage occurring prior to the Retroactive Date in the Schedule. Provided always that in the event of any Injury or Damage arising from continuous or continual inhalation, ingestion or application of any substance following the covered accident and where the Insured and the Company cannot agree when the Injury or Damage occurred, then:
1) Injury shall be deemed to have occurred when the Claimant first consulted a qualified medical practitioner in respect of such Injury;
2) Damage shall be deemed to have occurred when it first became evident to the Claimant, even if the cause was unknown.
- k) arising out of deliberate, conscious or intentional disregard of the Insured's technical or administrative management of the need to take all reasonable steps to prevent claims;
- l) Injury to any person under the contract of employment or apprenticeship with the Insured their contractor(s) and/or Sub-contractor(s) when such injury arises out of the execution of such contract;
- m) arising out of contractual liability unless liability have existed in the absence of the specific contract;
- n) arising out any product guarantee;
- o) arising out of claims for failure of the goods or products to fulfil the purpose for which they were intended.

Who are required to take the policy-
All persons/ firms/ associations/ companies which own, operate or engage in commercial activities and seek to protect the third party bodily injury and property damage can opt for this Policy.
This policy only applies to claims for damages for injury or Damage caused by an Accident that takes place at the Insured Premises, In accordance with the Operative Clause, but only such claims in connection with Insured's Business specified in the Schedule
INDEMNITY:

Premium
Premium for Public Liability (Non Industrial) Insurance cover under the public liability insurance is based on the annual limit of Indemnity (AOY) and ratio between AOA and AOY.
COMPULSORY EXCESS
The Insured shall bear as Compulsory Excess the amount or percentage of the Each Accident Insurance Limit so stipulated in the Schedule. This Compulsory Excess shall be applicable to claims for both Injury and Damage, inclusive of Defence Costs arising out of any one Accident. The Company's liability shall attach only for claims in excess of such Compulsory Excess of minimum Rs. 1000/- (And Voluntary Excess if any, opted by the Insured).
VOLUNTARY EXCESS
In the event of the insured opting, the policy shall be subject to a Voluntary Excess as mentioned in the Schedule. This Voluntary Excess shall be applicable to claims or both Injury and Damage, inclusive of Defence Costs arising out of any one Accident. The Company's Liability shall attach only for claims in excess of such Compulsory and Voluntary Excess. - Public Liability- Act.

Under public liability insurance Act 1991 all companies/ individual/ persons owning/ dealing hazardous goods are required to take insurance policy satisfying the limits specified in the Act.
Under PLI Act the owner?s fault or negligence causing up to 12,500/-

Scope of cover-
- 1.This Policy is issued to Employers to provide compensation to their Employees in respect of accidents and diseases of occupation, whether or not such employees come within the scope of the Workmen?s Compensation Act, 1923, and subsequent amendments thereto.
Any risk, or any part thereof, for which a rate is not provided in the tariff, must be submitted to appropriate Reg.Offices who fix the Tariff rate for such risks.
Liability covered
- 2. The Tariff provides for two forms of insurance viz :-
Table ?A? - Indemnity against legal liability to all employees (whether or not coming within the definition of the term Workmen) under the W.C.Act 1923 and subsequent amendment to the said Act prior to the date of issue of the policy, the Fatal Accidents Act, 1855 and at Common Law.?
Table ?B? - Indemnity against legal liability under the Fatal Accidents Act, 1855 and Common Law. (Table ?B? policies may not be issued to cover employees who fall within the definition of ?Workmen? under the Workmen?s Compensation Act, 1923 as amended).
No Policy is to be issued to cover liability in excess of that provided by the Tariff forms of Policies and Endorsements unless specifically authorised.
- 3. (a) No policy is to be issued which covers only a portion of the legal liability except in the case of Insurances (i) to cover fatal accidents only in Coal Mines; (ii) in respect of risks situated in Karnataka State whereunder no liability is to be assumed in respect of Miners? Phthisis or Silicosis under the Mysore Workmen?s Compensation Regulation.

(b) When table ?A? policy is issued all employees coming within the provision of the WC Act 1923 and subsequent amendments by the said Act must be included. In the case of employees in Private employee a policy may be issued covering any class of servants for which separate rates are fixed provided that class are included in the policy.
N.B.1 In the case of public Bodies and/or Muncipalities, it is, however, permissible to insure complete Sections or Units thereof separately as individual risks, such as Power Houses, Water Works, Gas Works, Transport Service, Sewage, etc. provided all the employees who are entitled to the benefits of the Workmen?s Compensation Act, 1923, of the Department or Unit concerned are included under the terms of any Policy issued in respect thereof.
N.B.2 In the case of risk coming under the purview of the Employees State Insurance Act 1948 it is however permissible to issue separate Table ?B? Workmen?s Compensation Policies covering those members of the staff, who are not ?employees? within the meaning of that Act, provided all such employees in the Insured?s service are included therein.
Note 1:- The above Regulation does not however, prohibit the issue of joint or separate policies by two or more Insurers sharing the insurance of a risk as Co-Insurers, provided alwasys that the entire legal liability in respect of the risk is fully covered, reimbursement by the insurers being limited to their agreed proportions, and the period of cover under the joint or different policies is concurrent.
Note 2:- In the event of non-renewal of any of the policies, or alteration in the terms of cover granted under any of the policies all insurers sharing the risk must be advised by the leading Office.
Terms of Insurance:- 4. (a) All policies are to be issued for 12 months except that;
(1) Policies may be issued for a period in excess of 12 months where an additional odd period is required to make a policy renewable on a particular date to meet the convenience of the Insured.

All premiums must be paid in advance for the full term of the Policy.

Cancellation:
(b)No refund may be granted for the cancelment of annual Policies unless the policies are cancelled by the Company as provided under Policy Condition No.7
